No, you can't go to jail because your payday loan check bounces

People contact our office every week and ask if they can go to jail for writiing a “bad check” in order to get an online payday loan or similar local loan. Contrary to most of the patter you hear from bill collectors, checks that are either post dated or specifically provided with knowledge that they cannot be cashed when provided are exempted from Florida’s worthless check statute. If bill collectors tell you that you will be arrested, they are reporting you to the State Attorney or that charges are being filed against you, contact our office immediately as this type of conduct typically runs afoul of the Florida Consumer Collections Practices Act, Fla. Stat. Chap. 559.
