Sleazy Hotels are Actually Landlords

For those displaced by the CORONA Virus, and forced to live in “extended stay” hotels or motels, be aware that many sleazy hotel owners are abusing and violating the law by claiming they are “hotels” and have transient guests as a means to circumvent the protections of the Florida Residential Landlord & Tenant Act, Fla. Stat 83 Part II. This statute provides various protections including written notice to terminate a tenancy, proper handling of advanced rent and security deposits, and judicial evictions, not being tossed out by the Sheriff on demand. This is also used to circumvent discrimination laws such as those under the FHA protecting familie  The most common scam is the claim that one must be present in the unit for X period of time to be qualified as a tenant. This is false. The standard is whether the room is in fact the primary residence of the individual which be established day one (1) and the are certain factors where its actually presumed that the room is a residential rental and not a transient guest at a hotel. This means that many such hotel are illegally acting as apartments. If you are in this situation or were illegally evicted by a hotel owner during COVID you may have a right to sue them for damages and even make them pay or reimburse your legal fees.
